In the US foetal personhood laws have been used to jail or forcibly detain women for refusing a c-section, attempting suicide, falling down a flight of stairs, or disclosing a history of addiction to their doctor.

I am writing to you to ask that you please oppose any proposed “fetal personhood” legislation.

Whilst recognising the devastating circumstances that have led to Zoe’s law being proposed and considered by parliament, and with the greatest compassion for the families affected by this tragedy, I am extremely concerned that any legislation granting rights to fetuses would have potential to have unintended consequences for pregnant women, and access to abortion care.

I’m aware that in the US foetal personhood laws have been used to jail or forcibly detain women for refusing a c-section, attempting suicide, falling down a flight of stairs, or disclosing a history of addiction to their doctor.

I am also aware that medical and legal experts have previously voiced their concerns about proposed foetal personhood laws and their potential to create uncertainty for medical professionals’ liability if a medical treatment would benefit a pregnant woman but harm a foetus. And the potential that such laws could endanger the already limited access to abortion care in NSW.
